By signing below, the Participant acknowledges that they have read, understood, and voluntarily agree to the terms and conditions set forth in this Liability Waiver and Release Agreement ("Agreement") with Dynamic Training & Fitness. The Participant understands that engaging in fitness activities — including but not limited to personal training sessions, exercise classes, equipment use, combat sports instruction, and all related activities — involves inherent and foreseeable risks of physical injury, illness, or death.
The Participant expressly agrees to release, waive, discharge, and hold harmless Dynamic Training & Fitness, and its owners, operators, employees, independent contractors, instructors, agents, and affiliates (collectively, the "Released Parties") from any and all claims, demands, liabilities, damages, losses, costs, or expenses — including reasonable attorney's fees — arising out of or in any way connected with the Participant's participation in any fitness activities, programs, or services provided by Dynamic Training & Fitness, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by applicable law.
The Participant acknowledges that they are voluntarily choosing to participate in physical fitness activities and fully understands the nature of the risks involved. The Participant expressly assumes all risks — known and unknown — associated with such participation, including but not limited to muscle strains, sprains, fractures, cardiovascular events, and other injuries that may result from physical exertion, equipment use, or instruction received.
The Participant agrees to indemnify, defend, and hold harmless Dynamic Training & Fitness and its Released Parties from and against any and all claims, demands, losses, liabilities, damages, costs, or expenses — including reasonable attorney's fees — arising out of or related to the Participant's participation in any fitness activities or services provided by Dynamic Training & Fitness, including in the event of the Participant's injury, disability, or death.
The Participant acknowledges and confirms that they are in adequate physical condition to safely participate in a personal training program. Prior to commencing any training sessions, the Participant agrees to disclose to their trainer any known medical conditions, physical limitations, injuries, or health concerns that may affect their ability to exercise safely. If any doubt exists regarding the Participant's physical readiness, the Participant agrees to obtain written clearance from a licensed physician or qualified healthcare provider before beginning any training activity. Dynamic Training & Fitness reserves the right to request proof of medical clearance at any time should concerns arise regarding the Participant's health or safety.
If the Participant is under the age of 18, this Agreement must be reviewed and executed by a parent or legal guardian. By signing below, the parent or legal guardian represents that they have read and fully understand this Agreement, consent to the minor's participation in all activities provided by Dynamic Training & Fitness, and accept full legal responsibility for any risks, liabilities, or claims arising from the minor's participation. The parent or legal guardian further agrees to indemnify and hold harmless Dynamic Training & Fitness and its Released Parties from any and all claims arising from the minor's participation.
The Participant certifies that they have read this Agreement in its entirety, fully understand its terms, and voluntarily agree to be bound by them. The Participant acknowledges that they have had the opportunity to seek independent legal counsel prior to signing and knowingly waive that right.
